We have designed a program can be tailored to match each individual’s current fitness level with our comprehensive health assessment, including our non-invasive scanning device, Sudoscan. The scan can identify risk factors for cardiovascular disease and diabetes in under 3 minutes. We also take BMI, waist to height ratio, and blood pressure at enrollment to get a complete health picture.

We believe that wellness is not only physical, but also encompasses emotional and financial health. That's why we have created the first fully insured wellness product. How It Works

  1. Complete Scan, blood pressure, waist to height ratio measures at enrollment
  2. Receive log-in information prior to effective date via email
  3. On effective date, log in for the first time and take health risk assessment
  4. After results are shown, the game will walk you through selecting your first set of goals based on a recommended intensity level
  5. Change Screen name under "My Profile" tab. This will be the name that all friends will see instead of your name
  6. Select nutrition, physical activity, and lifestyle goals and get started!
  7. Track daily progress at least once a week to retain goal
  8. As you log in and accomplish goals, you will receive points and medals to reinforce progress
  9. Track weight, inches, and blood pressure points lost as you gradually create healthier habits!

I need details on how the HealthQuest game generates a claim payment

Based upon your participation in the game, you are rewarded with claim payments that go to you directly via check or direct deposit. Double check your My Profile / Personal section in the HealthQuest game to validate your personal data.

What if I don't play the game?

If you don't log into the game once every 30 days, you will receive an email reminding you to log in the first month. After 60 days of no log in, a coach will give you a call to work with you to help get over any hurdles you are experiencing. If you do not log in for 90 consecutive days, you will receive a final email and be removed from the game. We do not want to take your premium if you are not enrolled in the game; rather, you will be removed from the game and your benefits simultaneously. You have the option to continue to pay for your benefits out of pocket at this time.

Can I create my own goals?

You can definitely create custom goals. Just send your goal idea to wellness@cypressai.com to submit. We will review the goal, write it up and add it to our database so not only you get to use your custom goal but you have the chance to help others in the game as well.

What kind of incentives are there?

We want to give you any and all opportunities to earn rewards for taking control of your health. Cypress will be providing periodic lotteries for all employees enrolled in the game, for things like trips, electronics, and tickets to events. Your employer will also have the chance to offer incentives specific to your company, like an additional paid day off or catered lunch or spa day to the division with the greatest participation. For everyone in the HealthQuest system, you receive points for each log in, goal accomplished and level improved. These points can be redeemed for anything from movie tickets to a trip to Hawaii.

Will people see my information?

No one will see any of your information unless you share it with them. Your results are completely anonymous you create an alias upon your first log in. At enrollment, you receive an employee ID number that will serve as your log in ID, and that will be what is shown when a health coach looks at your information. No personal information is shared with employers, aside from who is participating and who needs to be removed from the game.

How do I receive my claim payment?

Your claim payment will arrive at the same time as your paycheck from your employer, in the same way that your employer's check arrives. If it's a direct deposit, you will see a separate deposit from Cypress' payroll services, but if you receive a paper check, you will receive a separate paper check. All you have to do is get scanned once a year to receive your claim payment each month for Tier 1, and for Tier 2, you only need to log in once every 30 days to retain your benefits and receive your payment. While you only need to log in once a month, our hope is that you will want to log in much more often to track your progress!

Can my family participate?

We encourage as many family members as possible to play our wellness game. Partnering with your employer, we will have wellness fairs where your family can get scanned, learn about wellness, and have fun in the process! The stronger your support network both in and out of the office the more likely you are to achieve your wellness goals.

Do I have to participate?

The program is completely voluntary, but with additional insurance with no out of pocket cost and a wellness game that is tailored to your current level of fitness, there's no downside!

Fight the flu: 8 tips for beating bugs this season

With widespread outbreaks and no cure in sight, there’s no denying it’s going to be a particularly nasty cold and flu season.

While over-the-counter treatments can bring some relief or help shorten the duration of symptoms, your best bet is to take a preventative approach to try to ward off bugs before they take hold.

Below are a few immunity-boosting tips to help stave off sickness this season:

  1. Get a flu shot. The CDC recommends a yearly flu vaccine as the first and most important step in defending your body from flu viruses. Although there are many different flu viruses circulating, the vaccine is designed to protect against the three that research suggests will be most common.
  2. Wash your hands. One of the simplest yet most effective ways in which you can stop bugs from entering your body is by practicing the correct hand washing technique. Use warm water, plenty of soap and do it for about 20 seconds (Need a timer? Hum the "Happy Birthday" song from beginning to end twice).
  3. Mind your diet. Sugar can suppress the immune system, so cut back on post-holiday sweets and alcohol. Instead, load up on antioxidant- and vitamin-rich fruits and veggies, which help keep your immune system running strong.
  4. Manage stress levels. Another immunity-killer is both chronic and daily stress, which will leave your body ill-equipped to fight infections. Decrease stress by taking time out for yourself, whether that’s practicing meditation, getting a massage or simply going for a walk.
  5. Get ample rest. A tired body is one that’s also more prone to illness. Aim for a good stretch of uninterrupted sleep each night, ranging anywhere from seven to eight hours for most adults.
  6. Break a sweat. The health benefits of exercise are endless, including increased circulation and blood flow, which helps keep your immune system oxygenated and strong – not to mention, it’s a terrific way to reduce stress (see above).
  7. Keep well hydrated. Most of us need around half an ounce of non-caffeinated fluids for each pound of body weight daily to maintain proper hydration. This helps detox the body, carry nutrients to cell and keep mucous membranes moist, which lessens the likelihood of cold or flu bugs invading your nose or lungs.
  8. Look on the bright side. Do yourself a favor, and lighten up. Scientific evidence has shown that laughter not only helps people breathe easier, but it also massages the heart and vital organs and may increase the release of disease-fighting cells of the immune system.

Smaller Portions Work As Well As Larger Portions In Delaying Hunger And Craving

How much chocolate would you need to eat to be satisfied? Less than half as much as you think, according to this recently published Cornell University snacking study. Using chocolate chips, apple pie, and potato chips, researchers Ellen van Kleef, Mitsuru Shimizu, and Brian Wansink designed a study to determine if people who were given smaller portions of snack foods would feel hungrier or satisfied fifteen minutes after eating.

Two groups with different portion sizes were tested. The larger portion size group was given 100g of chocolate, 200g of apple pie, and 80g of potato chips, all slightly larger than the recommended portion sizes. This equaled 1370 calories in snack foods. The other group was given 10g, 40g, and 10g of these same foods respectively, for a total of 195 calories. The two groups were given as much time to eat as needed, and were asked to fill out surveys to rate the liking, familiarity, and boredom with the food. They were also asked to rate their hunger and craving before the food was presented and fifteen minutes after the taste tests ended.

The results remarkably showed that smaller portion sizes are capable of providing similar feelings of satisfaction as larger ones. Those given larger portions consumed 77% more food, amounting to 103 calories more, but they did not feel any appetite enhancing or stronger feelings of satiety than the group with the smaller portions. Overall these findings reflect the importance of portion size. While larger portions result in increased food intake, smaller portions may make you feel equally satisfied. The smaller portions can lead to a decline in hunger and desire that would help people limit their food intake. So, next time you are craving a snack food, remember that you can feel similarly satisfied with one handful as you would with two!

The health studies that conclude that people should sit less, and get up and move around more, have always struck me as fitting into the "well, duh" category.

But a closer look at the accumulating research on sitting reveals something more intriguing, and disturbing: the health hazards of sitting for long stretches are significant even for people who are quite active when they’re not sitting down. That point was reiterated recently in two studies, published in The British Journal of Sports Medicine and in Diabetologia, a journal of the European Association for the Study of Diabetes.

Suppose you stick to a five-times-a-week gym regimen, as I do, and have put in a lifetime of hard cardio exercise, and have a resting heart rate that’s a significant fraction below the norm. That doesn’t inoculate you, apparently, from the perils of sitting.

The research comes more from observing the health results of people’s behavior than from discovering the biological and genetic triggers that may be associated with extended sitting. Still, scientists have determined that after an hour or more of sitting, the production of enzymes that burn fat in the body declines by as much as 90 percent. Extended sitting, they add, slows the body’s metabolism of glucose and lowers the levels of good (HDL) cholesterol in the blood. Those are risk factors toward developing heart disease and Type 2 diabetes.

"The science is still evolving, but we believe that sitting is harmful in itself," says Dr. Toni Yancey, a professor of health services at the University of California, Los Angeles.

Yet many of us still spend long hours each day sitting in front of a computer.

The good news is that when creative capitalism is working as it should, problems open the door to opportunity. New knowledge spreads, attitudes shift, consumer demand emerges and companies and entrepreneurs develop new products. That process is under way, addressing what might be called the sitting crisis. The results have been workstations that allow modern information workers to stand, even walk, while toiling at a keyboard.

Dr. Yancey goes further. She has a treadmill desk in the office and works on her recumbent bike at home.

If there is a movement toward ergonomic diversity and upright work in the information age, it will also be a return to the past. Today, the diligent worker tends to be defined as a person who puts in long hours crouched in front of a screen. But in the 19th and early 20th centuries, office workers, like clerks, accountants and managers, mostly stood. Sitting was slacking. And if you stand at work today, you join a distinguished lineage — Leonardo da Vinci, Ben Franklin, Winston Churchill, Vladimir Nabokov and, according to a recent profile in The New York Times, Philip Roth.

DR. JAMES A. LEVINE of the Mayo Clinic is a leading researcher in the field of inactivity studies. When he began his research 15 years ago, he says, it was seen as a novelty.

"But it's totally mainstream now," he says. "There's been an explosion of research in this area, because the health care cost implications are so enormous."

Steelcase, the big maker of office furniture, has seen a similar trend in the emerging marketplace for adjustable workstations, which allow workers to sit or stand during the day, and for workstations with a treadmill underneath for walking. (Its treadmill model was inspired by Dr. Levine, who built his own and shared his research with Steelcase.)

The company offered its first models of height-adjustable desks in 2004. In the last five years, sales of its lines of adjustable desks and the treadmill desk have surged fivefold, to more than $40 million. Its models for stand-up work range from about $1,600 to more than $4,000 for a desk that includes an actual treadmill. Corporate customers include Chevron, Intel, Allstate, Boeing, Apple and Google.

"It started out very small, but it's not a niche market anymore," says Allan Smith, vice president for product marketing at Steelcase.

The Steelcase offerings are the Mercedes-Benzes and Cadillacs of upright workstations, but there are plenty of Chevys as well, especially from small, entrepreneurial companies.

In 2009, Daniel Sharkey was laid off as a plant manager of a tool-and-die factory, after nearly 30 years with the company. A garage tinkerer, Mr. Sharkey had designed his own adjustable desk for standing. On a whim, he called it the kangaroo desk, because “it holds things, and goes up and down.” He says that when he lost his job, his wife, Kathy, told him, “People think that kangaroo thing is pretty neat.”

Today, Mr. Sharkey's company, Ergo Desktop, employs 16 people at its 8,000-square-foot assembly factory in Celina, Ohio. Sales of its several models, priced from $260 to $600, have quadrupled in the last year, and it now ships tens of thousands of workstations a year.

Steve Bordley of Scottsdale, Ariz., also designed a solution for himself that became a full-time business. After a leg injury left him unable to run, he gained weight. So he fixed up a desktop that could be mounted on a treadmill he already owned. He walked slowly on the treadmill while making phone calls and working on a computer. In six weeks, Mr. Bordley says, he lost 25 pounds and his nagging back pain vanished.

He quit the commercial real estate business and founded TrekDesk in 2007. He began shipping his desk the next year. (The user must supply the treadmill.) Sales have grown tenfold from 2008, with several thousand of the desks, priced at $479, now sold annually.

"It’s gone from being treated as a laughingstock to a product that many people find genuinely interesting," Mr. Bordley says.

There is also a growing collection of do-it-yourself solutions for stand-up work. Many are posted on Web sites like howtogeek.com, and freely shared like recipes. For example, Colin Nederkoorn, chief executive of an e-mail marketing start-up Customer.io, has posted one such design on his blog. Such setups can cost as little as $30 or even less, if cobbled together with available materials.

UPRIGHT workstations were hailed recently by no less a trend spotter of modern work habits and gadgetry than Wired magazine. In its October issue, it chose “Get a standing desk” as one of its “18 Data-Driven Ways to Be Happier, Healthier and Even a Little Smarter.”

The magazine has kept tabs on the evolving standing-desk research and marketplace, and several staff members have become converts themselves in the last few months.

"And we're all universally happy about it," Thomas Goetz, Wired’s executive editor, wrote in an e-mail — sent from his new standing desk.

Four wellness trends for 2013

As employers are continuing to look for ways to control health care costs, wellness programs are expected to remain a popular benefit offering in 2013. Wellness programs aren't new to the benefits industry, but employers are taking steps to get more out of these programs this year.

Focusing on retention and sustainability

So much attention is given to engaging employees in wellness programs, which is projected to remain a key focus, but it shouldn't stop there, says Stephanie Pronk, senior vice president at Aon Hewitt, a human resources consulting firm in Chicago. Employers must also be concerned with retention. For a wellness program to work effectively, it should create a lifestyle change with sustainable results, and more employers are accomplishing this through workplace practices, such as walking meetings and standing work stations.

"When you think about why safety programs are so successful in organizations, it's because they're engrained in the culture," Pronk says. "It's part of the way they do their work every day, so we need to work at health and wellness in the same way. We need culture changes to support healthy behaviors in the long term."

Involve employees' families

Pronk expects to see more employers target not only employees but family members, as well. Employers can do this by sending a family kit that includes games involving the entire family and healthful recipes and shopping lists. This teaches everyone who might be on the employer’s health plan to choose the right types of food and portion sizes, which reinforces those healthful habits.

"It's pretty easy to get the employee engaged, but it's a little harder to get the spouses and dependents engaged, too," Pronk says. "We're finding that unit is really important in terms of changing behavior and sustaining that behavior."

Transparency

In an effort to increase personal accountability, employers are looking to create a wellness environment that embraces transparency, Pronk says. Employers can promote transparency by celebrating major milestones regarding the health of the employees in the organization and distributing a quarterly health report.

"It is helpful when employers share what is happening with the health of the organization to ensure individuals understand how they make an impact," Pronk says. "Keeping that transparency and those lines of communication is important."

Practicing community involvement

While employers have been pushing healthy living among employees, Pronk also expects to see more employers encourage wellness in the community. An employee might want to become more active, but if there are few places to safely walk or run, it makes it more difficult. Considering the power employers have on their communities, more employers are taking this opportunity to push for better amenities, such as safe walking and running paths.

"Employers have a lot of influence on the communities they live in and they provide jobs in, so we see that aspect as a sphere of influence that will make a healthy and high-performing work force," Pronk says. "That’s going to be a big push in 2013."

You may transfer the entire physical copy of pre-recorded Software and accompanying documentation on a permanent basis to another person as long as you retain no copies (including archival or backup copies) of the Software, accompanying documentation, or any portion or component of the Software or accompanying documentation, and the recipient agrees to the terms of this Agreement. Special Features, including content otherwise unavailable without a single-use serial code, are not transferrable to another person under any circumstances and Special Features may cease functioning if the original installation copy of the software is deleted or the pre-recorded copy is unavailable to the user. The Software is intended for private use only. NOTWITHSTANDING THE FOREGOING, YOU MAY NOT TRANSFER ANY PRE-RELEASE COPIES OF THE SOFTWARE.
TECHNICAL PROTECTIONS. The Software may include measures to control access to the Software, control access to certain features or content, prevent unauthorized copies, or otherwise attempt to prevent anyone from exceeding the limited rights and licenses granted under this Agreement. If the Software permits access to Special Features, only one copy of the Software may access those features at one time. Additional terms and registration may be required to access online services and to download Software updates and patches. Only Software subject to a valid license can be used to access online services, including downloading updates and patches. You may not interfere with such access control measures or attempt to disable or circumvent such security features. If you disable or otherwise tamper with the technical protection measures, the Software will not function properly.
USER CREATED CONTENT: The Software may allow you to create content, including but not limited to a gameplay map, a scenario, screenshot of a car design or a video of your game play. In exchange for use of the Software, and to the extent that your contributions through use of the Software give rise to any copyright interest, you hereby grant Licensor an exclusive, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and license to use your contributions in any way and for any purpose in connection with the Software and related goods and services, including the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of protection granted to intellectual property rights by applicable laws and international conventions. You hereby waive any moral rights of paternity, publication, reputation, or attribution with respect to Licensor’s and other players’ use and enjoyment of such assets in connection with the Software and related goods and services under applicable law. This license grant to Licensor, and the above waiver of any applicable moral rights, survives any termination of this License.
INTERNET CONNECTION. The Software may require an internet connection to access internet-based features, authenticate the Software, or perform other functions. In order for certain features of the Software to operate properly, you may be required to have and maintain (a) an adequate internet connection and/or (b) a valid and active account with an online service as set forth in the Software documentation, including but not limited to third-party gaming platform, Licensor or a Licensor affiliate. If you do not maintain such accounts, then certain features of the Software may not operate or may cease to function properly, either in whole or in part.


II. INFORMATION COLLECTION & USAGE.

By installing and using this software, you consent to these information collection and usage terms, including (where applicable) transfer of data to Licensor and affiliated companies into a country outside of the European Union and the European Economic Area. If you connect to the Internet when using the Software, either through a gaming platform network, or any other method, Licensor may receive information from hardware manufacturers or gaming platform hosts and may automatically collect certain information from your computer or gaming unit. This information may include, but is not limited to, user IDs (such as gamer tags and screen names), game scores, game achievements, game performance, locations visited, buddylists, hardware MAC address, internet protocol address, and your usage of various game features. All information collected by Licensor is intended to be anonymous information that does not disclose your identity or constitute personal information, however, if you include personal information (such as your real name) in your user ID, then such personal information will automatically be transmitted to Licensor and used as described herein.

The information collected by Licensor may be posted by Licensor on publicly-accessible web sites, shared with hardware manufacturers, shared with platform hosts, shared with Licensor’s marketing partners or used by Licensor for any other lawful purpose. By using this Software you consent to the Licensor’s use of related data, including public display of your data such as identification of your user created content or displaying your scores, ranking, achievements and other gameplay data. If you do not want your information shared in this manner, then you should not use the Software.


III. WARRANTY

LIMITED WARRANTY: Licensor warrants to you (if you are the initial and original purchaser of the Software) that the original storage medium holding the Software is free from defects in material and workmanship under normal use and service for 90 days from the date of purchase. Licensor warrants to you that this Software is compatible with a personal computer meeting the minimum system requirements listed in the Software documentation or that it has been certified by the gaming unit producer as compatible with the gaming unit for which it has been published, however, due to variations in hardware, software, internet connections and individual usage, Licensor does not warrant the performance of this Software on your specific computer or gaming unit. Licensor does not warrant against interference with your enjoyment of the Software; that the Software will meet your requirements; that operation of the Software will be uninterrupted or error-free, or that the Software will be compatible with third party software or hardware or that any errors in the Software will be corrected. No oral or written advice provided by Licensor or any authorized representative shall create a warranty. Because some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, some or all of the above exclusions and limitations may not apply to you.

If for any reason you find a defect in the storage medium or Software during the warranty period, Licensor agrees to replace, free of charge, any Software discovered to be defective within the warranty period as long as the Software is currently being manufactured by Licensor. If the Software is no longer available, Licensor retains the right to substitute a similar piece of Software of equal or greater value. This warranty is limited to the storage medium and the Software as originally provided by Licensor and is not applicable to normal wear and tear. This warranty shall not be applicable and shall be void if the defect has arisen through abuse, mistreatment, or neglect. Any implied warranties prescribed by statute are expressly limited to the 90-day period described above.

Except as set forth above, this warranty is in lieu of all other warranties, whether oral or written, express or implied, including any other warranty of merchantability, fitness for a particular purpose or non-infringement, and no other representations or warranties of any kind shall be binding on Licensor.

When returning the Software subject to the limited warranty above, please send the original Software only to the Licensor address specified below and include: your name and return address; a photocopy of your dated sales receipt; and a brief note describing the defect and the system on which you are running the Software.

IN NO EVENT WILL LICENSOR BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO, DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, PROPERTY DAMAGE, LOST PROFITS OR PUNITIVE DAMAGES FROM ANY CAUSES OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWAWRE, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE, WHETHER OR NOT LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL LICENSOR’S LIABILITY FOR ALL DAMAGES (EXCEPT AS REQUIRED BY APPLICABLE LAW) EXCEED THE ACTUAL PRICE PAID BY YOU FOR USE OF THE SOFTWARE.

BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS AND/OR EXCLUSION OR LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. THIS WARRANTY SHALL NOT BE APPLICABLE SOLELY TO THE EXTENT THAT ANY SPECIFIC PROVISION OF THIS WARRANTY IS PROHIBITED BY ANY FEDERAL, STATE, OR MUNICIPAL LAW, WHICH CANNOT BE PRE-EMPTED. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.

TERMINATION: This Agreement is effective until terminated by you, by the Licensor, or automatically upon your failure to comply with its terms and conditions. Upon any termination, you must destroy or return the physical copy of Software to the Licensor, as well as permanently destroy all copies of the Software, accompanying documentation, associated materials, and all of its component parts in your possession or control including from any client server or computer on which it has been installed.

U.S. GOVERNMENT RESTRICTED RIGHTS: The Software and documentation have been developed entirely at private expense and are provided as "Commercial Computer Software" or "restricted computer software." Use, duplication or disclosure by the U.S. Government or a U.S. Government subcontractor is subject to the restrictions set forth in subparagraph (c)(1)(ii) of the Rights in Technical Date and Computer Software clauses in DFARS 252.227-7013 or as set forth in subparagraph (c)(1) and (2) of the Commercial Computer Software Restricted Rights clauses at FAR 52.227-19, as applicable. The Contractor/ Manufacturer is the Licensor at the location listed below.

EQUITABLE REMEDIES: You hereby agree that if the terms of this Agreement are not specifically enforced, Licensor will be irreparably damaged, and therefore you agree that Licensor shall be entitled, without bond, other security, proof of damages, to appropriate equitable remedies with respect any of this Agreement, in addition to any other available remedies.

INDEMNITY: You agree to indemnify, defend and hold Licensor, its partners, licensors, affiliates, contractors, officers, directors, employees and agents harmless from all damages, losses and expenses arising directly or indirectly from your acts and omissions to act in using the Software pursuant to the terms of the Agreement.

MISCELLANEOUS: This Agreement represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them. It may be amended only by a writing executed by both parties. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions of this Agreement shall not be affected.

GOVERNING LAW. This Agreement shall be construed (without regard to conflicts or choice of law principles) under the laws of the State of Texas, as such law is applied to agreements between Texas residents entered into and to be performed within Texas, except as governed by federal law. Unless expressly waived by Licensor in writing for the particular instance or contrary to local law, the sole and exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the state and federal courts located in Licensor’s principal corporate place of business (Harris County, Texas, U.S.A.). Both parties consent to the jurisdiction of such courts and agree that process may be served in the manner provided herein for giving of notices or otherwise as allowed by Texas state or federal law. The parties agree that the UN Convention on Contracts for the International Sale of Goods (Vienna, 1980) shall not apply to this Agreement or to any dispute or transaction arising out of this Agreement.

Apple App Store Additional License Terms

These license terms are in addition to all other terms of the Limited Software Warranty; License Agreement, and Information Use Disclosures. If any Software is provided to you through the Apple Inc. ("Apple") App Store, then the following additional terms and conditions in this paragraph apply. This Agreement is solely between you and Licensor, and not with Apple. You acknowledge that Apple has no obligation to furnish any maintenance or support services to you in connection with the Software. In the event of any failure of the Software to conform to the Limited Warranty in this Agreement, you may notify Apple, and Apple will refund the purchase price for the Software. Except for the foregoing, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software. Any claim in connection with the Software related to product liability, a failure to conform to applicable legal or regulatory requirements, claims under consumer protection or similar legislation or intellectual property infringement are governed by this Agreement, and Apple is not responsible for such claims. You must comply with the App Store Terms of Service, including the Usage Rules. The license to the Software is a non-transferable license to use the Software only on an iPhone or iPod touch that you own or control. You represent that you are not located in any U.S. embargoed countries or on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's list or Entity List. Apple is a third party beneficiary to this Agreement and may enforce this Agreement against you.
All other terms and conditions of the EULA apply to your use of the Software.


Beaterator Additional License Terms

These license terms are in addition to all other terms of the Limited Software Warranty; License Agreement, and Information Use Disclosures.
Owners of this Software may use it to create their own tracks by arranging the content and/or adding new content to create their own compositions ("User Tracks"). Cypress Associates grants owners a worldwide and royalty-free license to use, distribute and non-commercially exploit. This license is non-exclusive and all Software owners are licensed to use the same content to create. All User Created Content terms herein shall apply to upload to any website or on-line service related to the Software or shared with other players using in-game features. Additional terms and restrictions may apply to any supplemental music, sounds, loops, or “stems” purchased or downloaded for use with the Software.
The sounds and loops connected to the Software may NOT be reformatted, mixed, filtered, re-synthesized, or otherwise edited or altered for use in any kind of sampling product/package or software, regardless of whether such use is commercial or non-commercial. All users of this Software is prohibited from using it for any purpose that: (a) infringes the copyright, trademark, patent, trade secret, right of publicity or any other right of a third party, (b) is or may be libelous, defamatory or slanderous, or (c) any other use that is illegal in nature. All users of this Software hereby waive all claims against Cypress Associates, its parent, subsidiaries and affiliates, or any third-party based upon the Content.
